How to fill out a Babysitting Contract

A babysitting contract (or nanny agreement) sets clear expectations between parents and a sitter: the children and their needs, the schedule and pay, duties, house rules and emergency contacts.

How to fill it out

  1. Enter the parents' names, phone and address, and the sitter's name and phone, and note whether the sitter has current CPR or first aid training.
  2. Add a row for each child with age, allergies or medical needs and usual bedtime.
  3. Fill in the schedule, hourly rate, extra-child or overtime rate, how often pay is due and the payment method, plus your cancellation terms.
  4. Tick the duties you expect (meals, homework, bath and bedtime, driving, tidying up) and set the rules for screen time, visitors, outings and discipline.
  5. List two emergency contacts and the pediatrician; Poison Control in the U.S. is 1-800-222-1222.
  6. Both the parent and the sitter sign and date it, and each keeps a copy. Post the emergency contacts on the fridge too.

Tips

  • Leave written instructions for any medication, including the dose and time, and show the sitter where it is kept.
  • Agree on screen time, phone use, visitors and outings up front — they cause the most disagreements later.
  • If the sitter will drive your children, check their license and car seats, and confirm your auto insurance covers them.
  • Pay on a set schedule and keep a simple record of hours and payments.
  • Try a paid trial session while you are home before leaving the sitter alone with the kids.

FAQ

Do I need a contract with a babysitter?

It is not required, but for regular care — an after-school sitter or a nanny — a written agreement avoids misunderstandings about hours, pay, duties and cancellations.

Do I owe taxes for a nanny?

If you pay a household employee more than the IRS annual threshold in a year, you may owe Social Security and Medicare taxes and need to give a Form W-2. Sitters under 18 are generally exempt unless child care is their main job. See IRS Publication 926.

What is a typical cancellation policy?

Many families and sitters agree on 24 hours' notice. If the family cancels later than that, they pay a set number of hours; if the sitter cancels late, they help find a replacement.

Is this legal or tax advice?

No. It is a general template, not legal or tax advice. Employment and tax rules for household workers vary, so check IRS guidance and your state's rules or ask a professional.
