How to fill out a Sublease Agreement

A sublease agreement lets a tenant (the sublessor) rent all or part of their place to someone else (the subtenant) for part of the lease term. The original tenant stays responsible to the landlord, and the subtenant must follow the original lease.

How to fill it out

  1. Enter the sublessor (the current tenant), the subtenant, the landlord and the premises, plus the date and end date of the original lease.
  2. Set the sublease start and end dates — the end date must be on or before the original lease ends.
  3. Fill in the monthly rent, due day, who it is paid to, late fee, security deposit, who pays which utilities and any furnishings included.
  4. Read the terms about the original lease, the sublessor's duties and the condition of the unit and deposit, and edit them if needed.
  5. Check the box for landlord consent and get the landlord's signature if your lease requires it.
  6. The sublessor and subtenant sign and date it. Give the subtenant a copy of the original lease, which they agree to follow.

Tips

  • Read the subletting clause in your lease before you advertise the room. Many leases require the landlord's written consent.
  • Collect a security deposit and do a move-in walk-through with photos, so you can return the deposit fairly.
  • Keep paying the landlord on time yourself, even if the subtenant pays you late — you are still responsible under the original lease.
  • Agree on how utilities in your name will be split and paid, and put the amount or method in writing.
  • If you sublet a furnished unit, list the furniture and its condition on a separate page.

FAQ

Do I need my landlord's permission to sublet?

Often, yes. Many leases require written consent, and some states and cities have their own subletting rules. Subletting without required consent can be a lease violation.

Who is responsible if the subtenant doesn't pay?

The original tenant. The landlord can still hold you responsible for the full rent and any damage under the original lease.

Can the sublease last longer than my lease?

No. A sublease must end on or before the date the original lease ends.

Sublease vs. lease assignment?

In a sublease you stay on the lease and remain responsible. In an assignment, the new tenant takes over your lease, usually with the landlord's approval, and you may be released.

Is this legal advice?

No. This is a general template, not legal advice. Laws differ by state and city, so check your local rules or ask an attorney before relying on it for anything important.
