How to fill out a Payment Plan Agreement
Free Payment Plan Agreement template
A payment plan agreement is a written contract in which a debtor agrees to pay an existing debt to a creditor in installments over time. It states the total owed, any down payment, the payment amount and schedule, and what happens if a payment is late or missed.
How to fill it out
Enter the creditor's and debtor's names, addresses and phone numbers.
Write the total amount owed and the reason for the debt, such as an unpaid invoice.
Fill in the down payment, the balance to be paid, the installment amount, frequency and payment method.
List the due dates and amounts in the payment schedule; record payments as they come in — totals and unpaid amounts are calculated automatically.
Review the terms, then both parties sign and date the agreement and keep a copy.
Tips
Make sure the schedule adds up to the balance to be paid.
Give a receipt or written confirmation for every payment received.
Late fees must be reasonable and allowed by your state's law.
If you are collecting consumer debts for others, federal and state debt collection laws may apply.

FAQ
Is a payment plan agreement legally binding?
A signed agreement with clear terms is generally an enforceable contract. It also serves as written proof that the debtor acknowledged the debt.
What happens if the debtor misses a payment?
Under this template, the creditor may charge the late fee, and if a payment is more than 30 days late, give written notice and demand the full remaining balance. You can edit these terms to fit your situation.
How is this different from a promissory note?
A promissory note usually documents a new loan. A payment plan agreement sets up installments for a debt that already exists, such as an unpaid bill or rent.
